1. Operator & Acceptance of Terms

RailTrailWx (railtrailwx.com) is owned and operated by Entrain Weather, LLC, a Pennsylvania limited liability company. All rights, obligations, and liabilities under these Terms belong to Entrain Weather, LLC.

By accessing or using RailTrailWx, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to any part of these Terms, you may not use the service. Your continued use of RailTrailWx after any updates to these Terms constitutes acceptance of the revised Terms.

2. Decision Support, Not Decision-Making

RailTrailWx provides decision-support information based on user-supplied comfort preferences. It is not a safety tool.

• Comfort scores reflect your stated comfort thresholds, not objective safety, weather severity, or NWS warnings.
• RailTrailWx does not make decisions for you.
• Outdoor activities carry inherent risks. Trails expose participants to risks including severe weather, lightning, flash flooding, extreme heat or cold, wildlife encounters, and remote terrain with limited access to emergency services.
• You are solely responsible for all outdoor activity decisions, including in adverse or dangerous conditions.
• Custom scoring profiles can produce arbitrarily permissive results. A profile that vetoes nothing will return a score of 100 in any weather.
• Always consult official National Weather Service (NWS) forecasts and alerts, and exercise your own judgment before heading out.

BY USING RAILTRAILWX, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH OUTDOOR RECREATIONAL ACTIVITIES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE. YOU ACKNOWLEDGE THAT WEATHER CONDITIONS CAN CHANGE RAPIDLY AND THAT RAILTRAILWX COMFORT SCORES ARE DECISION-SUPPORT TOOLS ONLY, NOT SAFETY GUARANTEES. YOUR DECISION TO ENGAGE IN ANY OUTDOOR ACTIVITY IS SOLELY YOUR OWN, AND YOU VOLUNTARILY ACCEPT ALL RISKS INHERENT IN SUCH ACTIVITIES. THIS ASSUMPTION OF RISK AND WAIVER OF LIABILITY FOR NEGLIGENCE IS ENTERED INTO FREELY AND VOLUNTARILY IN CONNECTION WITH OUTDOOR RECREATIONAL ACTIVITY AND IS INTENDED TO BE ENFORCEABLE TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, INCLUDING THE LAW OF THE COMMONWEALTH OF PENNSYLVANIA.

3. Description of Service

RailTrailWx, a service of Entrain Weather, LLC, provides weather-based comfort scoring and forecast information tailored to rail-trail recreation and user-defined comfort preferences. Features include:

• Hourly trail comfort scores derived from multiple Numerical Weather Prediction (NWP) models
• Customizable comfort profiles
• Interactive trail maps with weather overlays and NEXRAD radar
• NWS weather alerts for trail areas
• Route-specific scoring along trail segments
• Fleet-wide trip planning (the Plan tab), which ranks forecast windows across trails against your saved preferences
• Rest-of-today thunderstorm outlook for each trail
• A Logbook for recording trail visits and marking favorite trails
• Illustrated trail guides with facts, elevation, history, and tips
• Climate history for each trail, derived from long-term reanalysis data
• AI-generated trail Dispatches summarizing the forecast (see Section 4)
• User accounts for saved preferences and subscriptions

Free accounts include access to designated free trails, including one trail you may select and change on a recurring schedule; current selection rules are shown in the app.

If enabled by you, map location display is provided for convenience only. Browser or device location may be inaccurate, delayed, or unavailable, and it is not intended for emergency use, turn-by-turn navigation, or safety-critical decisions.

4. AI-Generated Trail Dispatches

RailTrailWx includes a feature called the Dispatch: a short written summary of the forecast for a selected trail and activity. Dispatches are produced by an artificial intelligence language model and are displayed automatically, without human review before publication.

• What a Dispatch is. A Dispatch restates values RailTrailWx has already computed, including comfort scores, the best window, temperature, humidity, wind, precipitation, thunderstorm outlook, and active National Weather Service alerts. It is that information rendered in sentence form. It is not an independent forecast, not a National Weather Service product, and not a safety assessment.
• Section 2 applies in full. A Dispatch is decision-support information and is subject to every limitation in Section 2 (Decision Support, Not Decision-Making). It reflects the comfort preferences you have chosen and does not evaluate whether conditions are safe for you.
• AI output can be wrong. Automated checks compare the numbers in each Dispatch against the underlying forecast before it is shown, and a Dispatch that fails those checks is redrafted or replaced with a plain-language summary. These checks reduce errors but do not eliminate them. Language models can produce inaccurate, incomplete, or misleading statements. Use Dispatches with healthy skepticism, and consult official NWS forecasts and alerts before heading out.
• Not for safety-critical decisions. Never rely on a Dispatch to decide whether it is safe to be outdoors, to interpret a weather warning, or to judge how much time you have before hazardous weather arrives.
• Third-party AI processing. Dispatches are generated using services provided by Anthropic, PBC. The information sent for generation consists of trail, activity, and forecast data. It does not include your name, email address, or account identifiers. Section 11 (Third-Party Services) applies to this processing.
• Availability and usage limits. Automatically generated Dispatches are provided for selected trails and activities and may change without notice. On-demand Dispatches, where you request a Dispatch for a trail, activity, or custom comfort profile of your choosing, require an active RailTrailWx Pass and are subject to fair-use limits on the number you may generate per minute, per day, and per calendar month. Applicable limits are shown in the app as you approach them. Entrain Weather, LLC may adjust these limits and may pause, restrict, modify, or discontinue the Dispatch feature at any time, including to manage service costs. Unused limits do not roll over between periods. Reopening a Dispatch that has already been generated does not count against your limits. No refund or credit is provided for unused Dispatches or for periods when the feature is unavailable.
• Automated use prohibited. Generating Dispatches by script or other automated means, or circumventing the usage limits, violates Section 5 (Acceptable Use) and may result in suspension or termination of your account.
• Retention. Generated Dispatches are retained by Entrain Weather, LLC, together with the forecast values used to produce them, for quality review, troubleshooting, and reproduction. See the Privacy Policy for more information.
• Use of Dispatch text. Dispatch text is RailTrailWx content and is subject to Sections 5 and 12. You may use Dispatches for your own personal, non-commercial purposes. You may not scrape, redistribute, or commercially exploit Dispatch text, or use it to train or evaluate any machine learning model, without prior written consent from Entrain Weather, LLC.

5. Acceptable Use

You agree to use RailTrailWx only for lawful purposes. You may not:

• Violate any applicable federal, state, or local laws or regulations
• Circumvent or attempt to bypass access controls or subscription restrictions
• Scrape, crawl, or harvest data from the service at scale without prior written consent from Entrain Weather, LLC
• Transmit malicious code, viruses, or any software intended to damage or interfere with the service
• Submit false, misleading, or fraudulent information
• Harass, defame, or harm other users or third parties
• Spam, phish, or engage in any unauthorized commercial messaging through the platform
• Reproduce, redistribute, or commercially exploit RailTrailWx content, comfort scores, or algorithms without authorization

RailTrailWx Comfort Score graphics may be shared provided they are reproduced in their entirety without alteration, including the name of the trail, the route (when displayed on the graphic), the score or comfort score odds, activity, forecast valid time, forecast generation time, www.RailTrailWx.com attribution, and the Personalized RailTrailWx Comfort Score notice of availability.

Personalized scores may be shared. When shared, they will be labeled “Personalized”, or a variant such as “Personalized Score” or “[First Name]’s Personalized Score” if a first name is set on the user's account, rather than the user's custom profile name. This labeling is required because personalized scores are user-specific and may not be meaningful or accurate to others.

Share buttons are provided next to the RailTrailWx Comfort Score graphics (on the forecast hero and in the hour detail card) for easy sharing that exactly meets these requirements. All other reproduction or redistribution of RailTrailWx content without written permission is prohibited.

Violations may result in immediate account termination and, where applicable, legal action.

6. User Accounts

When you create an account, you agree to provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality and security of your login credentials
• All activity that occurs under your account
• Notifying Entrain Weather, LLC promptly of any unauthorized use

Entrain Weather, LLC is not liable for losses resulting from unauthorized account access due to your failure to protect your credentials.

7. Subscriptions & Billing

The following billing terms apply:

• Subscriptions are billed monthly or annually as selected at time of purchase.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize Entrain Weather, LLC to charge your payment method on file for the applicable fee at the start of each billing period.
• Payment processing:All payments are processed securely through Stripe. By providing payment information, you agree to Stripe's terms of service and privacy policy.
• Cancellation: You may cancel at any time via your account settings or by contacting support@railtrailwx.com. Access continues through the end of the current billing period.
• Refunds: Subscription fees are non-refundable. No refunds or credits are provided for partial billing periods or unused time. If you believe you were charged in error, contact support@railtrailwx.com.
• Price changes: Entrain Weather, LLC reserves the right to modify subscription pricing. Changes will be communicated in advance and take effect at the start of your next billing period. Continued use after a price change constitutes acceptance of the new pricing.

7a. Early Access Feedback Offer

While RailTrailWx is in early access, Entrain Weather, LLC is offering a 50% discount coupon applicable to the first year of a paid RailTrailWx Pass subscription (maximum value: $5.00/month for the first 12 months on a monthly plan, or $30.00 total on an annual plan), subject to the following conditions:

• The participant must create a Free Pass account.
• The participant must start or have active the 7-day free trial of RailTrailWx Pass.
• The participant must send an email before the 7-day free trial ends to support@railtrailwx.com containing genuine feedback, such as bug reports, feature requests, usability comments, or other suggestions.
• One coupon per person. Coupons are issued at Entrain Weather, LLC's sole discretion.
• This offer is available only during the early access period and may be withdrawn at any time without notice.
• Coupons have no cash value and are not transferable.
• The coupon applies to the subscription price for the first year only. “First year” means the 12-month period beginning on the date the free trial of RailTrailWx Pass is started. On a monthly plan this covers up to 12 billing months within that period; on an annual plan it covers the first annual billing cycle. Standard pricing applies thereafter.

Entrain Weather, LLC reserves the right to modify or terminate this offer at any time. Submission of feedback does not guarantee receipt of a coupon. Maximum discount values are based on current pricing and are subject to change.

8. Disclaimer of Warranties

RailTrailWx and all content, features, and functionality are provided “as is” and “as available” without warranty of any kind, express or implied. To the fullest extent permitted by law, Entrain Weather, LLC expressly disclaims:

• All implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the service will be uninterrupted, error-free, or free of viruses or other harmful components
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of weather forecasts or comfort scores
• Any warranty regarding the accuracy, completeness, or currency of trail information, including trail guides, maps, routes, waypoints, mileage, elevation, surface descriptions, parking, amenities, points of interest, access rules, and historical or descriptive text
• Any warranty that defects will be corrected

Weather conditions can change rapidly and unexpectedly. RailTrailWx scores are derived from third-party NWP models (HRRR, ECMWF, GEFS, NBM, NAM, etc.) and do not substitute for official NWS forecasts, warnings, or advisories. Do not rely on RailTrailWx comfort scores for safety-critical decisions.

Trail content may be incomplete, out of date, or wrong. Trail routes, waypoints, distances, elevation, surfaces, parking, amenities, and descriptive or historical text are compiled from public sources, third-party data, automated processing, and our own editorial work. Trails change. Segments close, reroute, wash out, or pass through private land, and posted rules and conditions govern over anything shown in RailTrailWx. Verify routes and access with the trail manager or land owner before you ride, and do not rely on RailTrailWx trail content for navigation or for safety-critical decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Entrain Weather, LLC and its members, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation property damage, loss of profits, loss of data, or other intangible losses, arising from or related to your use of or inability to use RailTrailWx, regardless of whether such damages were foreseeable and whether Entrain Weather, LLC was advised of the possibility of such damages.

Liability cap:In no event shall the total aggregate liability of Entrain Weather, LLC to you for all claims arising out of or relating to these Terms or your use of RailTrailWx exceed the greater of (a) the total fees you paid to Entrain Weather, LLC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) ten dollars ($10.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. TO THE EXTENT SUCH LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT TO THE EXTENT SUCH LIMITATIONS ARE PROHIBITED BY APPLICABLE LAW.

10. Account Termination & Suspension

Entrain Weather, LLC reserves the right to suspend or permanently terminate your account and access to RailTrailWx immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Conduct that Entrain Weather, LLC determines to be harmful to other users, third parties, or the service
• Non-payment of fees
• Fraudulent or unlawful activity

You may terminate your account at any time by contacting support@railtrailwx.com. Upon termination, your right to access the service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

11. Third-Party Services

RailTrailWx relies on third-party services to deliver its functionality, including but not limited to:

• Stripe: payment processing (subject to Stripe's Privacy Policy)
• Clerk: user authentication and account management
• Anthropic: AI language model used to generate Dispatches (see Section 4)
• Cloud infrastructure providers: hosting, databases, and compute
• Mapping, geocoding, and tile services: interactive map layers and place search
• NOAA / ECMWF: weather forecast model data

Entrain Weather, LLC is not responsible for interruptions, errors, data loss, or data handling practices caused by third-party services. Your use of third-party services through RailTrailWx is subject to their respective terms of service and privacy policies.

12. Intellectual Property

RailTrailWx is a product of Entrain Weather, LLC. All content, features, and functionality of RailTrailWx are the exclusive property of Entrain Weather, LLC or its licensors and are protected by applicable intellectual property law.

• Trademarks:“RailTrailWx,” “Entrain Weather,” the Entrain Weather logo, and related marks are trademarks of Entrain Weather, LLC. These marks may not be used in connection with any product or service without the prior written consent of Entrain Weather, LLC.
• Patents pending: One or more aspects of the RailTrailWx system, including the trail weather scoring methodology, comfort profile engine, model blending algorithms, and related processes, are the subject of pending patent applications. Unauthorized use, reproduction, or commercial exploitation of these methods is prohibited.
• Copyrighted content: The site design, graphics, text, and compilation of data presented by RailTrailWx are protected by copyright. Reproduction or redistribution without written permission from Entrain Weather, LLC is prohibited.
• Reservation of rights: All rights not expressly granted in these Terms are reserved by Entrain Weather, LLC.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of RailTrailWx shall be brought exclusively in the state or federal courts located in Pennsylvania. By using RailTrailWx, you consent to the personal jurisdiction of those courts. Entrain Weather, LLC's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entrain Weather, LLC reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via the updates page or by email. Your continued use of RailTrailWx after changes take effect constitutes your acceptance of the revised Terms.
